By accessing or using Doana's AI customs agent services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all users of the Service, including individual users, businesses, and any other entities that access or use our platform.
2. Description of Service
Doana provides AI-powered customs document processing and data extraction services for aviation, freight, and supply chain operations. Our Service includes automated extraction of customs data from documents such as commercial invoices, AWB/HAWB, EASA Form 1, FAA 8130-3, and other related documentation.
The Service integrates with email providers (Outlook, Gmail), messaging platforms (Slack, Teams, WhatsApp), and exports data in various formats (Excel, JSON, CSV, custom templates) for use with customs brokers, TMS, and ERP systems.
3. Account Registration and Security
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must notify us immediately of any unauthorized use of your account.
You may not share your account credentials with third parties or allow multiple users to use a single account unless your subscription plan explicitly permits this.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not use the Service to process documents that contain illegal content, violate any applicable laws or regulations, or infringe on the rights of third parties.
You are solely responsible for ensuring that your use of the Service complies with all applicable customs laws, trade regulations, and industry requirements in your jurisdiction, including but not limited to CARM, ICS2, CBAM, and UK CDS requirements.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Doana and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
You retain ownership of all documents and data you submit to the Service. By using the Service, you grant us a limited license to process, analyze, and extract data from your documents solely for the purpose of providing the Service to you.
6. Data Processing and Privacy
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to the data practices described in our Privacy Policy.
For business users processing customs documents, we act as a data processor on your behalf. You acknowledge that you are the data controller and are responsible for ensuring lawful processing of any personal data contained in documents you submit to the Service.
7. Payment and Billing
Certain features of the Service require payment of fees. You agree to pay all applicable fees as described on our pricing page or as otherwise agreed in writing. All fees are non-refundable unless otherwise specified.
We reserve the right to modify our pricing at any time. We will provide at least 30 days' notice before any price increases take effect for existing subscribers.
8. Limitation of Liability
To the maximum extent permitted by law, Doana shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.
While we strive for high accuracy in our AI extraction services, we do not guarantee 100% accuracy. You are responsible for reviewing and verifying all extracted data before submission to customs authorities or other parties.
9. Termination
You may terminate your account at any time by contacting us or through your account settings. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. We may retain certain data as required by law or for legitimate business purposes.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.
